Public Notice of Designation of an Area for Additional Licensing of Houses in Multiple Occupation
Notice is hereby given that the Cyngor Sir Ceredigion County Council has confirmed the designation of an additional licensing scheme in respect of Houses in Multiple Occupation (HMOs).
The Designation applies to the following HMOs (except those exempted by the relevant sections of the Housing Act 2004):
- HMOs occupied by 3 or more persons, forming three or more separate ‘households’, regardless of the number of storeys in the following specified wards only:
- Aberystwyth Bronglais
- Aberystwyth Central
- Aberystwyth North
- Aberystwyth Penparcau
- Aberystwyth Rheidol
- Faenor
- Llanbadarn Fawr Padarn
- Llanbadarn Fawr Sulien
- HMO occupied by 5 or more persons, forming two or more separate households, regardless of the number of storeys and applies to the whole of the County of Ceredigion
- Section 257 HMOs (Housing Act 2004) created by converting buildings into flats where the conversions did not meet the Building Regulations 1991 Standards and they have not been subsequently brought up to the relevant standards and applies to the whole of the County of Ceredigion
This scheme will be known as Ceredigion County Council’s Additional HMO Licensing Scheme 2024 (‘the Scheme’). The confirmation of the designation is in accordance with Section 56-60 of The Housing Act 2004 and Regulation 9 of The Licensing and Management of Houses in Multiple Occupation and Other Houses (Miscellaneous Provisions) (Wales) Regulations 2006.
The designation was made at a meeting of the Ceredigion County Council on the 19 March 2024. The Housing Act 2004 (Additional HMO Licensing) (Wales) General Approval 2007, which came into effect on 13 March 2007, applies to this designation.
The Scheme will be effective from 10 July 2024 and, unless revoked beforehand, will cease to have effect on 09 July 2029.
Any landlord, person managing or tenant whose property may fall within the criteria of this Scheme should seek advice from Housing Services (Porth Cymorth Cynner) for Ceredigion County Council as to whether their property is affected by the designation of this Scheme.
A person having control of or managing an HMO in the designated area must apply to Ceredigion County Council for a licence.
Failure to apply for a licence is an offence under Section 72(1) of The Housing Act 2004 for which a person may be subject to an unlimited fine. An application may also be made to the Residential Property Tribunal to make a Rent Repayment Order requiring the repayment of up to 12 months’ rent collected during the time the property was unlicensed.
An application to licence an HMO must be in a prescribed format, must contain certain particulars and must be accompanied by the requisite fee, a copy of the relevant application form is available on our Licencing page.
